Service Agreement

These terms govern your use of NetFusion Solutions services. By engaging our services, you agree to these terms and conditions.

  • Acceptance: By using our services, you acknowledge that you have read and agree to these terms
  • Modifications: We may update these terms with notice to active clients
  • Binding Agreement: These terms create a legally binding agreement between you and NetFusion Solutions Pty. Ltd.

Service Delivery & SLA

NetFusion Solutions will deliver IT infrastructure services as outlined in individual service agreements.

  • Uptime Guarantee: We maintain a high uptime SLA for managed services
  • Support Response: 24/7 emergency support with 15-minute response time
  • Service Credits: SLA breaches may result in service credits as specified in your agreement
  • Scheduled Maintenance: Planned maintenance windows with advance notice
  • Performance Monitoring: Continuous monitoring and reporting of service performance

Client Responsibilities

To ensure successful service delivery, clients are responsible for:

  • Accurate Information: Providing complete and accurate information about systems and requirements
  • System Access: Timely access to systems, facilities, and personnel as needed
  • Compliance: Adhering to applicable regulations and industry standards
  • Payment Terms: Timely payment according to agreed invoicing schedule
  • Communication: Prompt notification of issues, changes, or concerns

Limitation of Liability

NetFusion Solutions liability is limited as specified in individual service agreements and applicable law:

  • Direct Damages: Liability limited to amounts paid for services in the preceding period
  • Indirect Damages: We are not liable for indirect, incidental, or consequential damages
  • Force Majeure: Not liable for failures due to circumstances beyond reasonable control
  • Third-Party Services: Not responsible for third-party service failures or issues

Termination

Either party may terminate services under the following conditions:

  • Notice Period: Written notice as specified in your agreement
  • Material Breach: Immediate termination for material breach of terms
  • Data Return: Client data will be returned in agreed format upon termination
  • Outstanding Payments: All outstanding fees must be paid upon termination
